Effective Date: Upon User Acceptance/Installation of Software

1. INTRODUCTION

ROCK LAB PRIVATE LIMITED (“the Company”, “we”, “us”, or “our”), a company incorporated under the laws of India, is committed to protecting your privacy. This Privacy Policy explains our practices regarding the collection, use, and disclosure of information through the KittySuite IDE software (“Software”) and related services.

By installing, accessing, or using the Software, you agree to the practices described in this Privacy Policy. This policy is incorporated by reference into our EULA.

2. INFORMATION WE COLLECT

In accordance with Section 11 of the EULA, we collect the following types of information:

A. Personal Information

  • Account Information: Your email address, name, and account credentials provided during registration or purchase.
  • Payment Information: Handled by our third-party payment processors. We do not store full credit card details on our servers.

B. License Verification Data (Machine Identifiers)

To enforce our per-user, per-machine licensing model (Section 2.3 of the EULA), we collect:

  • Unique hardware identifiers (CPU ID, Motherboard ID, MAC Address, Hard Drive Serial Numbers).
  • Device name and system configuration details.
  • IP Address and approximate geographic location.
  • License key status and activation records.

C. Usage and Telemetry Data

  • Software Metrics: Feature utilization statistics, performance metrics, and usage patterns.
  • Diagnostic Data: Error reports, crash logs, and system environment snapshots.
  • Anonymized Data: Aggregated data used to improve software stability and user experience.

D. AI Interaction Context

Prompts and Snippets: To provide AI Services (code completion, refactoring, etc.), the Software may capture specific code snippets or natural language prompts you input. Note: As per Section 5.5 of the EULA, Rock Lab Private Limited does not use this data to train our own models, but it is transmitted to third-party providers.

3. HOW WE USE YOUR INFORMATION

We use the collected data for the following purposes:

  • License Enforcement: To verify that the Software is used on authorized machines and to prevent piracy.
  • Service Provision: To provide the core functionalities of the IDE and integrated AI Services.
  • Improvement and Development: To analyze bugs, optimize performance, and develop new features.
  • Communication: To send technical notices, updates, security alerts, and support messages.
  • Legal Compliance: To comply with Indian law, including the Information Technology Act, 2000, and export control regulations.

4. AI SERVICES AND THIRD-PARTY PROVIDERS

The KittySuite IDE facilitates interactions with third-party AI service providers (e.g., OpenAI, Anthropic, or similar inference engines).

  • Data Transmission: When you use AI features, snippets of your code or prompts are sent to these third parties.
  • No Training by Licensor: We expressly confirm that we do not store or use your code to train machine learning models.
  • Third-Party Terms: Third-party AI providers have their own privacy policies and data retention practices. By using AI Services, you acknowledge that your data is subject to their policies. We are not responsible for how these third parties handle your data.

5. DATA SHARING AND DISCLOSURE

We do not sell your personal data. We disclose information only in the following circumstances:

  • Third-Party Service Providers: To vendors who assist with license verification, cloud hosting, and payment processing.
  • Legal Requirements: If required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency).
  • Business Transfers: In connection with any merger, sale of company assets, or acquisition of all or a portion of our business.

6. DATA SECURITY

We implement industry-standard administrative, technical, and physical security measures to protect your License Verification Data and Personal Information. However, as stated in Section 11.3 of the EULA, the Company cannot guarantee absolute security, and you use the Software at your own risk.

7. DATA RETENTION

  • License Data: Retained for the duration of your active subscription or perpetual license.
  • Telemetry/Diagnostic Data: Periodically purged once it is no longer needed for performance analysis.
  • Legal Obligations: We may retain certain data as required by Indian law (e.g., for tax or audit purposes).

8. YOUR RIGHTS (INDIA DPDP ACT & INTERNATIONAL STANDARDS)

Depending on your jurisdiction, you may have the following rights:

  • Access: The right to request copies of your personal data held by us. To prevent others from obtaining your data by abusing this right, we will only make available this data in hard copy, and after physically verifying your identity, at our premises.
  • Correction: The right to request that we correct inaccurate or incomplete information.
  • Erasure: The right to request that we delete your data (this may result in immediate termination of your license, as per EULA Section 13).
  • Withdrawal of Consent: You may opt-out of telemetry collection via the Software settings.

9. INTERNATIONAL DATA TRANSFERS

Information collected, including hardware identifiers and PII, may be transferred to—and maintained on—computers located outside of your state or country where data protection laws may differ. By using the Software, you consent to this transfer.

10. CHILDREN’S PRIVACY

The Software is intended for use by software developers and is not directed at children under the age of 13 (or the applicable age in your jurisdiction). We do not knowingly collect personal information from children.

11. CHANGES TO THIS POLICY

We reserve the right to update this Privacy Policy at any time. We will notify you of any changes by posting the new Privacy Policy within the Software or on our official website. Your continued use of the Software after such changes constitutes your acceptance of the new terms.
